These Terms and Conditions form a legally binding agreement between you and Access Hunter (“Access Hunter,” “Company,” “Platform,” “we,” “us,” or “our”).

These Terms govern your access to and use of Access Hunter, including its website, mobile applications, communications, membership services, hunting-land access listings, ice shack listings, booking services, payment services and related features.

By creating an account, purchasing a membership, making or accepting a Booking, listing property or equipment, accessing hunting land, renting an ice shack or otherwise using Access Hunter, you confirm that you have read, understood and agreed to these Terms. If you do not agree, you must not use Access Hunter.

1. Definitions

“Access Provider” means a Landowner, leaseholder, occupier, manager or other person who lists or authorizes access to land through Access Hunter.

“Booking” means a reservation or confirmed arrangement for land access, an ice shack rental, equipment rental, accommodation, experience or another service offered through Access Hunter.

“Booking Fee” means the amount charged for a Booking, including or excluding taxes, Platform fees, deposits and other charges as shown at checkout.

“Guest” means a person who books, purchases or participates in land access, an ice shack rental or another activity through Access Hunter.

“Host” means a Landowner, Access Provider, ice shack owner, rental operator or other person offering land access, property, equipment or services through Access Hunter.

“Landowner” means the registered owner, authorized occupier or lawful controller of property listed on Access Hunter.

“Listing” means any hunting-land access opportunity, ice shack, equipment, accommodation, service or activity displayed through Access Hunter.

“Member” means a person with an active Access Hunter membership or subscription.

“Platform Services” means the technology, communications, booking, membership and payment-facilitation services provided by Access Hunter.

“User” means any person who visits, registers for or uses Access Hunter, including Guests, Members, Hosts, Landowners and Access Providers.

2. Nature Of The Platform

Access Hunter operates as an online marketplace and booking facilitator connecting Guests with independent Hosts and Access Providers.

Unless expressly stated otherwise in writing:

• a. Access Hunter does not own, possess, manage, supervise or control land, ice shacks, rental equipment or activities offered by Users;

• b. Access Hunter is not a hunting outfitter, hunting guide, fishing guide, firearms instructor, wildlife authority, land surveyor, ice-safety inspector, transportation provider, property manager or insurer;

• c. Hosts and Access Providers are independent persons and are not employees, agents, partners, representatives or joint venturers of Access Hunter;

• d. a Booking creates a direct agreement between the Guest and the applicable Host or Access Provider, subject to these Terms and applicable Listing terms; and

• e. Access Hunter does not guarantee the condition, legality, availability, boundaries, suitability, accessibility or safety of any Listing.

Access Hunter may provide tools for identification, verification, messaging, payment processing, reviews or dispute assistance. These tools do not constitute an endorsement, certification, warranty or guarantee.

3. Eligibility

You must be at least the age of majority in your jurisdiction to create an account, enter into a Booking or list land, property or equipment. A minor may participate only where permitted by law, accompanied and actively supervised by a parent or legal guardian, and all required licences, permits and authorizations are held. You may not use Access Hunter if prohibited from entering contracts, possessing or using firearms, hunting, fishing or participating in the relevant activity.

4. User Accounts

You must provide complete, current and accurate information. You are responsible for protecting login credentials, all account activity, promptly reporting unauthorized access, maintaining accurate contact and payment information, and ensuring persons included in a Booking receive and agree to applicable rules, disclosures and waivers.

You may not create an account using false information, impersonate another person, transfer or sell an account, create multiple accounts to evade restrictions, or permit account use that violates these Terms. Access Hunter may request identity documents, licences, proof of authority, insurance information or other verification. Verification does not guarantee identity, qualifications, reliability or future conduct.

5. Memberships And Subscriptions

Any membership fee charged to hunters, guests, or Users is charged exclusively for access to and use of the Access Hunter platform — including the ability to search, browse, message, and book available hunting land access, ice shack rentals, and related services facilitated through the Platform. The membership fee is payment for Platform Services (the technology, booking infrastructure, communication tools, and administrative convenience Access Hunter provides) and is not, and must not be construed as, payment for the right to hunt, fish, trap, or otherwise access or use wildlife or land.

Where hunting land listed on the Platform is offered free of charge by the Landowner, the membership fee does not constitute a fee for access to that land or its wildlife resources, and Access Hunter does not sell, lease, or charge for hunting access itself. Access to hunt on listed land is granted directly and independently by the Landowner, at no cost, subject to applicable provincial and federal hunting laws, licences, tags, and open seasons. Users remain solely responsible for holding all legally required hunting licences, tags, and permits, independent of any Platform membership.

Access Hunter may offer free or paid memberships with disclosed benefits, limitations and renewal terms. Unless otherwise stated, fees are charged in advance, memberships may renew automatically, taxes and transaction charges may be added, benefits are personal and non-transferable, and membership does not guarantee Listing availability, hunting or fishing success, wildlife presence or Booking acceptance.

You may cancel renewal through account settings or help@accesshunter.com. Cancellation prevents future renewal but does not automatically result in a refund for the current billing period except where required by law. Access Hunter may modify membership features or pricing with legally required notice.

6. Listings

Hosts and Access Providers are solely responsible for Listings. Each Listing must accurately disclose material information, including location, boundaries, restricted areas, approved routes, availability, permitted and prohibited activities, vehicle and parking restrictions, firearm-discharge restrictions, livestock, crops, hazards, Guest limits, capacity, utilities, equipment, fees, deposits, cancellation conditions, accessibility limitations, required permits and Host rules. Access Hunter may edit, decline, suspend or remove Listings that appear incomplete, misleading, unsafe, unlawful or inconsistent with these Terms.

7. Bookings

A Booking becomes confirmed when accepted or instantly booked, required payment or authorization succeeds, and required acknowledgements, waivers or verification are completed. A Booking authorizes only the activities, dates, times, locations and participants stated in the confirmation. It does not grant ownership, tenancy, leasehold rights, access outside the approved area or period, permission for additional persons, permission for regulated activities unless specifically authorized and lawful, or entry onto neighbouring property.

8. Pricing, Payments And Taxes

Prices and charges are displayed before purchase and may include Host charges, Platform fees, membership fees, deposits, cleaning, equipment, payment-processing charges, taxes and other disclosed amounts. Access Hunter may use an independent payment processor. Hosts are responsible for tax obligations unless Access Hunter is legally required to collect or remit. Access Hunter may withhold or delay payouts for chargebacks, refunds, fraud, safety issues, disputes, regulatory obligations or suspected violations.

9. Cancellations, Refunds And Booking Changes

Cancellations, refunds and changes are governed by the Booking Policy, Listing-specific terms and mandatory law. No refund is guaranteed for unsuccessful hunting or fishing, wildlife absence or behaviour, personal scheduling changes, minor weather changes, failure to obtain licences, removal for misconduct, late arrival, early departure, unsuitable personal equipment or dissatisfaction with accurately disclosed conditions. Different rules may apply where access becomes unavailable, the Host cancels, a material feature was misrepresented, an official closure applies or a serious safety condition exists.

10. User Responsibilities

Users must act lawfully, safely and respectfully. Guests must obtain required licences and permits; confirm seasons, species, quotas, equipment, tagging, reporting and discharge rules; remain within boundaries; comply with law and Host instructions; assess weather, roads, terrain, water and ice; use suitable clothing and safety equipment; safely handle firearms, fuel, heaters, vehicles and equipment; supervise minors; avoid damage; remove waste and carcass remains as required; report damage, injury and unsafe conditions; and leave property and equipment as required.

11. Hunting And Firearms

Access Hunter does not issue hunting licences, firearm licences, tags or regulatory approvals. Each Guest is responsible for lawful possession, transport, storage and discharge of firearms or bows, lawful species and dates, lawful methods, lawful entry and retrieval, and required transport, registration, tagging and reporting. No Listing guarantees wildlife presence or harvest. Guests must never discharge toward a person, dwelling, vehicle, livestock, roadway or unsafe backstop, outside authorized areas, while impaired, or contrary to law or Host instructions.

12. Land Access

Access is limited to identified boundaries. Maps, pins and coordinates may be approximate. Guests must seek clarification before entering uncertain areas. Guests may not enter neighbouring land, cut fences or vegetation, damage crops or livestock, misuse gates, use unauthorized routes or vehicles, construct blinds or fires without permission, remove natural or cultural objects except lawfully harvested wildlife, or transfer access rights. Access may be restricted for safety, law enforcement, wildfire, weather, livestock, agriculture, environmental protection or legal compliance.

13. Ice Shack Rentals

Travel and activity on frozen water involve serious risks. Hosts do not guarantee ice thickness, strength or uniformity, safe vehicle access, continuous heating, power or communications, fish availability, protection from extreme weather or emergency response times. Guests must comply with occupancy, heating, ventilation, fire safety, fishing, waste and check-in rules. Smoking, open flames, unauthorized heaters, equipment modification and hazardous-material storage are prohibited unless expressly permitted.

Fees charged for ice shack rentals, and any membership required to access ice shack Listings, are payment for (a) rental of the physical ice shack structure and/or (b) use of the Platform to search, browse, and book available ice shack rentals. These fees are not payment for, and do not confer, any right to fish, and do not replace or substitute for any provincial or federal fishing licence, tag, quota, or regulatory requirement. Users remain solely responsible for holding and complying with all legally required fishing licences and regulations, independent of any Platform membership or rental fee paid.

14. Camping Bookings

Where a Landowner enables overnight camping on their property, all camping fees are set and determined solely by the Landowner and are charged exclusively for lodging, accommodation, and use of the camping area.

Camping fees are separate from, and are not payment for, any right to hunt, fish, or access wildlife — whether or not hunting access is also available on the same property. A camping Booking may be made with or without an accompanying grant of hunting access; the availability of one does not include or guarantee the other unless expressly stated in the Listing.

15. Alcohol, Cannabis And Impairment

No User may handle or discharge a firearm, drive, operate equipment, use a fuel-burning appliance or participate in a hazardous activity while impaired. Hosts may prohibit alcohol, cannabis and other substances. Illegal drugs and unlawful conduct are prohibited.

16. Host And Landowner Responsibilities

Hosts must have authority, provide accurate material information, disclose known non-obvious hazards, provide access or equipment substantially as described, maintain required permits and insurance, comply with applicable law, avoid unlawful discrimination, respect privacy, maintain equipment reasonably suitable for represented use, and communicate material changes. Hosts must not claim Access Hunter inspected or certified a Listing unless expressly authorized in writing.

17. Reviews And User Content

Users retain ownership of submitted content but grant Access Hunter a worldwide, non-exclusive, royalty-free licence to host, reproduce, display, format and use it to operate, promote and improve Access Hunter. Content must not be false, misleading, defamatory, privacy-infringing, unlawful, threatening, discriminatory or manipulative. Access Hunter may remove violating content.

18. Prohibited Conduct

Users must not facilitate unlawful acts, bypass Platform fees, scrape or interfere with Access Hunter, misuse User information, submit fraudulent disputes, damage property, trespass, threaten or endanger others, misrepresent qualifications or authority, arrange poaching, or create unreasonable risks to people, animals, property or the environment.

19. Safety Incidents And Emergencies

In an emergency, contact 911 or the appropriate authority before Access Hunter. Access Hunter does not provide rescue, medical assistance, ice rescue, wildlife enforcement or roadside assistance. Serious injuries, firearm incidents, lost persons, property damage, wildlife offences, suspected carbon monoxide exposure, fires and vehicle accidents must be reported to appropriate authorities and Access Hunter where appropriate.

20. Insurance

Access Hunter does not guarantee that any User carries insurance or that coverage applies. Hosts are responsible for appropriate property, commercial, general liability, rental, outfitting and other insurance. Guests are responsible for any desired health, accident, travel, vehicle, hunting, equipment or personal liability insurance.

21. Assumption Of Risk

Outdoor recreation, hunting, fishing, firearms use, rural travel and frozen-water activity involve inherent and other risks, including serious injury, illness, property damage, exposure, hypothermia, carbon monoxide poisoning, fire, drowning, falling through ice, firearm injury, wildlife encounters, uneven terrain, agricultural operations, road conditions, equipment failure, delayed emergency response and death.

22. Disclaimers

To the fullest extent permitted by law, Access Hunter is provided “as is” and “as available.” Access Hunter does not warrant uninterrupted or secure operation, User reliability or identity, Listing safety or legality, wildlife or fish presence, suitability, safe weather or terrain, or complete and current third-party information. Non-excludable legal rights remain unaffected.

23. Limitation Of Liability

To the fullest extent permitted by law, Access Hunter and its directors, officers, employees, contractors and affiliates will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or loss of profit, opportunity, data, goodwill or enjoyment. Access Hunter’s aggregate liability will not exceed the greater of the Platform fees paid by the claimant in connection with the event or $100. This limitation does not apply where liability cannot lawfully be limited or excluded.

24. Release

To the fullest extent permitted by law, Users release Access Hunter from claims arising from another User’s acts or omissions, Listing conditions, outdoor risks, inaccurate Host information, unauthorized Guest conduct, wildlife presence or absence, and User disputes, except where claims cannot lawfully be released.

25. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless Access Hunter and its directors, officers, employees, contractors and affiliates from claims and costs arising from your breach, Listing, Booking, activity, violation of law, property damage, injury, User content, missing authority or permits, or persons you invite or include.

26. Suspension And Termination

Access Hunter may warn, restrict, suspend or terminate accounts or Bookings for violations, fraud, non-payment, safety or legal risks, false information, regulatory requirements or protection of Users, wildlife, property or the public. Where reasonable and lawful, notice and an opportunity to respond will be provided.

27. Disputes Between Users

Guests and Hosts should first attempt direct resolution through Access Hunter messaging. Access Hunter may request evidence and facilitate a non-binding resolution but is not required to decide disputes or compensate parties unless required by law or an express protection program.

28. Complaints And Platform Disputes

Complaints may be sent to help@accesshunter.com and should include account information, Booking reference, issue description, evidence and requested resolution. Before formal proceedings, the parties will attempt good-faith written negotiation for at least 30 days, except where urgent relief or a statutory deadline applies.

29. Governing Law And Forum

These Terms are governed by the laws of Alberta, Canada. Subject to mandatory consumer rights, the courts located in Red Deer, Alberta, Canada will have exclusive jurisdiction.

30. Electronic Communications

You consent to electronic agreements, Booking confirmations, waivers, notices and receipts. Electronic acceptance, including selecting an acceptance box or completing a Booking, has the same effect as a handwritten signature to the extent permitted by law.

31. Privacy

Access Hunter’s handling of personal information is governed by its Privacy Policy. Location, identification and regulatory information may be collected where reasonably required for Platform operation, verification, Bookings, safety or legal compliance.

32. Changes To These Terms

Access Hunter may revise these Terms and will provide notice of material changes as required by law. Updated Terms apply prospectively from their effective date. Continued use constitutes acceptance where permitted by law.

33. General Terms

If a provision is unenforceable, it will be modified or severed to the minimum extent necessary. Failure to enforce is not a waiver. Users may not assign rights without consent. Access Hunter may assign these Terms as part of a merger, financing, restructuring, sale or transfer. These Terms and incorporated policies constitute the entire agreement.

34. App Acceptance

By creating an account, accessing or using the Access Hunter app or website, making or participating in a Booking, listing property or equipment, purchasing a membership, or selecting an electronic acceptance box, you confirm that you have read, understood and agreed to these Terms and Conditions, the User Waiver, the Landowner and Access Provider Terms where applicable, the Booking Policy, the Liability Acknowledgement and any additional rules or policies presented through Access Hunter.

Your continued use of Access Hunter constitutes your electronic acceptance of these documents and your agreement to be legally bound by them to the fullest extent permitted by law.

IMPORTANT LEGAL NOTICE

This document affects your legal rights. Read it carefully before accepting it.

In consideration of being permitted to access land, rent or occupy an ice shack, participate in hunting, fishing or related outdoor activities, and use services arranged through Access Hunter, I agree as follows:

1. Application Of This Waiver

This waiver applies to travel to, from and within property or frozen water; entry onto rural, agricultural, forested or undeveloped land; hunting, scouting, tracking and wildlife retrieval; firearm, bow and hunting-equipment use; fishing and ice fishing; ice shack use or occupancy; use of vehicles, trailers, snowmobiles, all-terrain vehicles, boats or equipment; overnight occupancy, cooking and heating; interaction with wildlife, livestock, Hosts, Landowners, other Guests and the public; and all related activities.

2. Acknowledgement Of Risks

I understand these activities involve inherent, obvious, hidden and unpredictable risks, including firearm or ammunition malfunction; accidental discharge; injury from bows, knives, tools or traps; falls; unstable ground; holes; ditches; cliffs; trees; fences; falling branches, snow or ice; wildlife attacks; disease; livestock; farm machinery; becoming lost; extreme weather; wildfire; thin or deteriorating ice; falling through ice; drowning; vehicle collisions or rollovers; fire; burns; explosion; fuel leaks; electrical failure; carbon monoxide; inadequate ventilation; illness; delayed rescue; negligent or unlawful conduct by others; inaccurate maps or boundaries; theft; property damage; serious injury; disability and death. This list is not complete.

3. Personal Responsibility

I am solely responsible for determining whether I am physically, mentally and legally capable of participating. I will comply with law, licences, permits and seasons; follow Host and regulatory instructions; independently evaluate weather, terrain, roads, water and ice; use suitable clothing and emergency equipment; safely handle firearms, heaters, vehicles and tools; remain sober; stay within boundaries; stop when conditions appear unsafe; and report injuries, damage, hazards and emergencies. A Booking, Listing, map, Host statement or Access Hunter communication is not a guarantee of safety.

4. Medical Condition And Fitness

I confirm that I am sufficiently fit to participate or have obtained medical advice I consider necessary. I am responsible for relevant medical needs and required medication or equipment. Neither Access Hunter nor the Host determines my medical fitness.

5. Firearms And Hunting Compliance

I will possess required licences, certificates, tags and authorizations. I will not unlawfully possess, transport or use a firearm; discharge in an unauthorized or unsafe direction; hunt prohibited species or outside lawful seasons; exceed quotas; trespass; hunt or handle firearms while impaired; or engage in poaching, unlawful baiting or another prohibited practice.

6. Ice And Water Conditions

No frozen surface can be represented as completely safe. Ice thickness and strength may change due to temperature, currents, springs, snow cover, pressure ridges, cracks, aeration, vegetation, vehicles and other factors. I am responsible for deciding whether to travel or remain on frozen water. Any measurement or route suggestion is limited to its place and time and is not a guarantee.

7. Voluntary Assumption Of Risk

I freely and voluntarily accept all risks connected with the Booking and participation, whether known or unknown, foreseeable or unforeseeable, and accept responsibility for injury, illness, death, loss or damage except to the extent responsibility cannot lawfully be waived.

8. Release Of Claims

To the fullest extent permitted by law, I release and forever discharge Access Hunter; the Host, Landowner and Access Provider; property occupiers, equipment owners and rental operators; their directors, officers, employees, contractors, agents, representatives, affiliates, successors and assigns; and others involved in providing the Booking, collectively the “Released Parties,” from claims relating to participation, including ordinary negligence, breach of contract, breach of statutory duty, premises conditions or equipment conditions. This release does not apply to non-waivable liability.

9. Covenant Not To Sue

To the fullest extent permitted by law, I agree not to bring or maintain a claim against a Released Party concerning a risk accepted or matter released under this waiver.

10. Indemnity

To the fullest extent permitted by law, I agree to indemnify the Released Parties from claims, losses, liabilities, property damage, fines, penalties, costs and reasonable legal fees resulting from my acts or omissions, breach, violation of law, injury or damage caused by me, conduct of a minor or person under my supervision, or a person I invite through my Booking.

11. Property Damage

I accept financial responsibility for damage caused by me or my group to land, crops, trees, habitat, livestock, fences, gates, roads, structures, ice shacks, heaters, generators, equipment, vehicles, trailers and neighbouring property, excluding ordinary wear from authorized use.

12. Emergency Assistance

I authorize emergency medical assistance when unable to consent, but no Released Party guarantees assistance. In an emergency, call 911. I am responsible for medical, transportation, evacuation, rescue or recovery costs to the extent permitted by law.

13. Personal Property

I am responsible for firearms, equipment, vehicles, valuables and personal belongings. Released Parties are not responsible for loss, theft or damage except where liability cannot lawfully be excluded.

14. Photography And Communications

No media consent is included unless separate consent is expressly requested and provided through Access Hunter.

15. Minors

Where a Booking involves a minor, I confirm that I am the minor’s parent or legal guardian or have lawful authority, accept supervision responsibility, will explain risks and rules appropriately, and accept this waiver on my own behalf. Any waiver relating to a minor applies only to the extent permitted by law.

16. Electronic Acceptance

Electronic acceptance is intended to constitute my signature and may be relied upon as evidence of agreement.

17. Governing Law

This waiver is governed by the laws of Alberta, Canada. Disputes will be resolved in the courts of Red Deer, Alberta, Canada, subject to mandatory legal rights.

18. Severability

If part of this waiver is unenforceable, it will be modified or severed to the minimum extent required and the remaining provisions continue.

19. Confirmation

By accepting this waiver, I confirm that I have read and understood it, understand it affects my legal rights, had the opportunity to obtain independent legal advice, accept it voluntarily, understand the activities may result in serious injury or death, and agree to be legally bound.

20. App Acceptance

By creating an account, accessing or using the Access Hunter app or website, making or participating in a Booking, listing property or equipment, purchasing a membership, or selecting an electronic acceptance box, you confirm that you have read, understood and agreed to these Terms and Conditions, the User Waiver, the Landowner and Access Provider Terms where applicable, the Booking Policy, the Liability Acknowledgement and any additional rules or policies presented through Access Hunter.

Your continued use of Access Hunter constitutes your electronic acceptance of these documents and your agreement to be legally bound by them to the fullest extent permitted by law.

These Landowner and Access Provider Terms supplement the Access Hunter Terms and Conditions and apply to every person who lists, provides, manages or authorizes access to land through Access Hunter. By creating or publishing a Listing, accepting a Booking or receiving a payout, you agree to these terms.

1. Authority To List Land

You represent that you own the listed land or have valid authority; obtained required consent; are not prohibited by a mortgage, lease, insurance policy, court order or agreement; have authority to enter the Booking agreement and receive payment; and will provide evidence upon request. Where land is leased, licensed, managed or subject to public-land rules, you must confirm commercial or paid recreational access is permitted.

2. Independent Host Status

You provide access as an independent Host or Access Provider. Nothing creates employment, agency, partnership, franchise, fiduciary or joint-venture status. You control availability, permitted activities and price subject to law and Access Hunter requirements and have no authority to bind Access Hunter.

3. Listing Accuracy

You must provide complete and accurate information about boundaries, entrances, parking, vehicle restrictions, dates, group size, species and activities, firearm restrictions, hunting areas, prohibited areas, livestock, crops, residences, roads, trails, fences, water crossings, known hazards, ongoing operations, other authorized users, accommodations, utilities, equipment, accessibility, check-in procedures, fees, deposits and cancellation rules. Update the Listing promptly when information changes.

4. No Guarantee Of Wildlife

You must not guarantee species presence, animal number or quality, harvest or catch, legality of harvesting an animal, or a particular result. Historical observations or habitat descriptions must be truthful, current and not misleading.

5. Property Boundaries

You are responsible for reasonably clear boundary and access information. Verify digital maps, coordinates and pins. Where boundaries are difficult to identify, provide written directions or orientation and disclose known disputes or unauthorized areas.

6. Access Permission

A confirmed Booking grants limited, temporary and revocable permission to enter and use the identified area for the authorized purpose and period. It does not create tenancy, leasehold, easement, exclusive possession, ownership or continuing access rights. Access ends when the Booking concludes or is cancelled.

7. Landowner Rules

You may establish reasonable rules for routes, gates, vehicles, hunting zones, firearm discharge, camping, fires, waste, carcass disposal, alcohol, cannabis, smoking, pets, minors, stands, blinds, wildlife retrieval, livestock, agriculture and check-in. Rules must be disclosed before Booking where reasonably possible and comply with law and Access Hunter policies.

8. Legal And Regulatory Compliance

You are responsible for laws relating to ownership, land use, agricultural or public-land access, commercial recreation, outfitting and guiding, hunting and wildlife, firearm discharge, short-term accommodation, building and fire safety, carbon monoxide, environmental protection, tax, licensing, consumer protection, privacy, accessibility and discrimination. Access Hunter does not provide regulatory approval.

9. Outfitting And Guiding

Do not offer guiding, outfitting, transportation, game processing or regulated services without required licences and clear descriptions. Land access alone must not be represented as a guided hunt unless lawful.

10. Safety And Hazard Disclosure

Take reasonable steps to identify and disclose known non-obvious hazards, including unsafe structures, wells, pits, cliffs, abandoned equipment, aggressive animals, traps, electrical or chemical hazards, active machinery, industrial or agricultural operations, damaged roads or bridges, wildfire, flood, other hunters and no-discharge areas. Promptly notify affected Guests of new material hazards.

11. Other Users Of The Property

Disclose whether Guests may encounter occupants, workers, livestock, other hunting groups, recreational users, neighbours or industrial operations. Manage simultaneous Bookings to avoid unreasonable safety risks.

12. Insurance

Obtain advice from a qualified insurance professional and maintain insurance required by law and appropriate for the Listing, potentially including property, farm, ranch, commercial general liability, recreational access, short-term rental, outfitter, guide, equipment and vehicle coverage. Do not assume personal or farm insurance covers paid access. Provide evidence upon request.

13. Taxes

You are responsible for applicable registration, income reporting, collection and remittance of taxes not collected by Access Hunter, and records. Access Hunter may collect, remit, report or withhold where required.

14. Bookings And Guest Communication

Respond within a reasonable period and communicate important instructions through Access Hunter. Request only lawful information reasonably needed. Honour confirmed Bookings unless cancellation is permitted or necessary for safety or legal compliance.

15. Cancellation By Landowner

You may cancel for inaccessibility, material hazards, government restrictions, severe weather, wildfire, flooding, agriculture, failed verification, intended law or rule violations, or other legitimate impossibility or safety reasons. Notify the Guest and Access Hunter promptly. Repeated avoidable cancellations may lead to fees or restrictions.

16. Refusal Or Revocation Of Access

You may refuse or revoke access for identity mismatch, unauthorized participants, missing licences, impairment, prohibited equipment, boundary or rule violations, dangerous or abusive conduct, threats or refusal of reasonable safety instructions. Document the reason where safe. Guest-caused revocation does not automatically require a refund.

17. Non-Discrimination

Comply with applicable human-rights and anti-discrimination laws. Legitimate safety, legal, capacity and property requirements must be applied lawfully and consistently.

18. Guest Privacy And Surveillance

Use cameras or monitoring devices only where lawful and disclosed. Never use surveillance in bedrooms, washrooms, changing areas or places with reasonable privacy expectations. Use Guest information only for Booking administration, safety, legal compliance, disputes or authorized purposes and protect it from unauthorized disclosure.

19. Damage And Incident Reporting

Promptly report serious injury or death, firearm incidents, suspected unlawful hunting, major property damage, missing persons, fires, hazardous releases, law-enforcement attendance and material safety incidents. Call 911 before Access Hunter in an emergency. Damage claims require reasonable evidence.

20. Payouts

Payouts follow Access Hunter’s disclosed schedule. Access Hunter may deduct or withhold fees, taxes, refunds, chargebacks, damage awards, amounts owed or reasonable reserves for disputes or fraud. Maintain accurate payout information.

21. Platform Fees And Off-Platform Transactions

Pay disclosed Platform fees. Do not move a Booking introduced through Access Hunter off-platform to avoid fees unless expressly permitted.

22. Landowner Representations

Each time you accept a Booking, you represent that the Listing is accurate, authority remains valid, no known restriction prevents the Booking, required insurance and permits remain in effect, known hazards are disclosed, access can be provided as described, and the Booking does not unreasonably conflict with other authorized use.

23. Indemnity

To the fullest extent permitted by law, indemnify Access Hunter and its directors, officers, employees, contractors and affiliates from claims and costs arising from your Listing, lack of authority, misleading information, undisclosed known hazards, violation of law, missing insurance or approval, injury or damage caused by your acts or omissions, ownership or neighbour disputes, or Listing income taxes.

24. Access Hunter’S Role And Liability

Access Hunter facilitates introductions, communications, Bookings and payments. It does not take possession or control of land or inspect or maintain it. Access Hunter is not liable for Guest conduct, wildlife activity, property conditions, third-party trespass or losses outside its reasonable control except where liability cannot be excluded.

25. Removal Or Suspension Of Listings

Access Hunter may suspend or remove Listings where authority is disputed, the Listing appears unsafe, unlawful or misleading, complaints are received, required documents are missing, cancellations repeat, financial disputes remain unresolved, or the Listing presents risk.

26. Record Retention

Retain Booking, payout, tax, insurance, safety and incident records for the legally required period.

27. Governing Law

These terms are governed by Alberta, Canada law. Courts in Red Deer, Alberta, Canada have jurisdiction subject to mandatory rights.

28. Acknowledgement

By accepting, you confirm authority to list land, understanding of Access Hunter’s marketplace role, responsibility for legal and insurance compliance, commitment to disclose material information and hazards, commitment to honour Bookings, and opportunity to obtain independent legal, tax and insurance advice.

29. App Acceptance

By creating an account, accessing or using the Access Hunter app or website, making or participating in a Booking, listing property or equipment, purchasing a membership, or selecting an electronic acceptance box, you confirm that you have read, understood and agreed to these Terms and Conditions, the User Waiver, the Landowner and Access Provider Terms where applicable, the Booking Policy, the Liability Acknowledgement and any additional rules or policies presented through Access Hunter.

Your continued use of Access Hunter constitutes your electronic acceptance of these documents and your agreement to be legally bound by them to the fullest extent permitted by law.

This Booking Policy applies to reservations made through Access Hunter and forms part of the agreement among the Guest, Host or Access Provider and Access Hunter.

1. Booking Confirmation

A Booking is not confirmed until accepted or instantly booked, payment or authorization succeeds, required verification is completed, and required waivers and acknowledgements are accepted. An inquiry, message or pending payment does not reserve availability.

2. Booking Information

The confirmation identifies the Listing, date and authorized period, Guest and approved participants, price, fees, deposit, taxes, permitted activities, cancellation terms, check-in and checkout requirements and Host rules. Guests must review confirmations promptly and report errors.

3. Person Making The Booking

The person making the Booking must be legally capable, provide accurate information, have authority for the group, ensure participants receive rules and safety information and complete required waivers, and accept financial responsibility for group conduct.

4. Group Size And Participants

Only registered or approved participants may attend. Hosts may refuse additional persons or charge additional fees. Lead Guest substitutions require approval. Minors must be accompanied and supervised as required.

5. Payment

The payment schedule is shown before confirmation. Access Hunter may charge in full, collect a deposit and balance, place an authorization or damage hold, process authorized additional charges or cancel for failed payment. Guests are responsible for applicable payment-provider and insufficient-fund charges and taxes.

6. Membership-Based Bookings

Some Listings or prices require active membership. Membership must remain valid as specified. Cancelling membership does not automatically cancel existing Bookings. Membership fees and Booking charges are separate unless expressly stated.

7. Cancellation Options

Flexible: A Guest may cancel at least 48 hours before the scheduled start and receive a refund of the Booking price, less any disclosed non-refundable Platform fee. Later cancellations are non-refundable.

Moderate: A Guest may cancel at least seven days before the scheduled start and receive the refund displayed at checkout. Cancellations within seven days are non-refundable, subject to mandatory law and exceptional circumstances.

Strict: A Guest may cancel at least 30 days before the scheduled start and receive the refund displayed at checkout. Cancellations within 30 days are non-refundable, subject to mandatory law and exceptional circumstances.

Custom: A Listing may use a clearly disclosed custom schedule approved by Access Hunter.

8. Calculation Of Cancellation Deadlines

Deadlines use local time at the Listing and the scheduled start or check-in time. If no time is stated, 12:00 p.m. local time applies. Cancellation is effective when submitted through Access Hunter or received through the designated support channel.

9. Non-Refundable Items

Subject to law and disclosure, Platform fees, membership fees, payment-processing charges, administrative charges, customized services, consumed add-ons and Guest-misconduct charges may be non-refundable.

10. Weather

Ordinary rain, snow, cold, heat, wind, reduced wildlife activity or discomfort does not automatically qualify for a refund. Different rules may apply for authority closures, legal inaccessibility, evacuation orders, immediate severe-weather danger, Host safety cancellation or Exceptional Circumstances. Guests remain responsible for suitable clothing, equipment and transportation.

11. Ice Conditions

Ice conditions vary and may change rapidly. Guests must not rely solely on Listings, photographs, measurements or Host statements. Where an ice shack cannot reasonably or lawfully be accessed, the Host may relocate it, provide an equivalent alternative, reschedule or cancel. Refunds or credits follow Host cancellation and Exceptional Circumstances provisions. A Guest who voluntarily declines while lawful operations continue remains subject to the Listing policy unless Access Hunter decides otherwise based on documented conditions.

12. Wildlife And Fishing Results

No refund is available solely because wildlife was not observed, an intended species was unavailable, a Guest did not harvest, fish were not caught, weather affected movement or another lawful user was present where shared access was disclosed.

13. Licences And Legal Eligibility

Guests must obtain all required licences, tags, permits, firearm documents and approvals. Failure to obtain or carry them does not create a refund right. Hosts may refuse access where required documents are missing.

14. Guest Cancellation

Cancel through Access Hunter and provide supporting documents when requesting an exception. Failure to attend without cancelling is a no-show and is non-refundable unless required by law or approved under Exceptional Circumstances.

15. Host Cancellation

Hosts should cancel only where reasonably necessary. If the Host cancels and the Guest is not at fault, Access Hunter may issue a full refund, offer credit, assist with a comparable Listing or approve rescheduling. Access Hunter is not responsible for consequential travel, accommodation, licence, income or replacement costs unless required by law.

16. Guest Misconduct

A Host may end a Booking without refund for legal violations, impairment, unsafe firearm handling, prohibited-area entry, unauthorized persons, damage, threats, harassment, occupancy or fire-safety violations, or refusal of reasonable safety instructions. Guests remain responsible for damage and additional costs.

17. Late Arrival And Early Departure

Late arrival does not extend the Booking. Early departure does not create a refund unless the Host materially failed to provide the booked service or Access Hunter approves an exception. The Host may treat a Guest as a no-show after two hours where the Guest has not communicated and delayed arrival creates a safety or operational issue.

18. Booking Modifications

Changes require availability and Host approval and may change price, cancellation deadlines, taxes, fees, security deposits or applicable terms. A change is effective only when confirmed through Access Hunter.

19. Transfers And Resale

Bookings may not be sold, auctioned or transferred without Access Hunter and Host approval. Unauthorized resale may result in cancellation without refund.

20. Damage Deposits And Additional Charges

Access Hunter or Hosts may collect or authorize damage deposits. Additional charges may apply for damage, excessive cleaning, missing items, unauthorized participants or pets, late checkout, smoke remediation, waste, lost keys or other documented breaches. Guests receive notice and a reasonable response opportunity subject to payment-network deadlines and emergencies.

21. Refund Processing

Approved refunds return to the original payment method unless otherwise required. Bank and payment-provider processing times are outside Access Hunter’s control. Currency conversion and third-party charges may not be refundable.

22. Chargebacks

Before initiating a chargeback, Users should contact Access Hunter and allow a reasonable resolution opportunity. Fraudulent or abusive chargebacks may result in suspension and cost recovery. Lawful payment-dispute rights remain unaffected.

23. Exceptional Circumstances

Access Hunter may provide refunds, credits, rescheduling or adjustments where unusual events prevent or legally prohibit a Booking, including evacuation orders, government closures, wildfire, flood, natural disaster, sudden legal prohibition, serious documented illness, injury or death, widespread transportation shutdown, material safety defects or comparable events. Documents do not guarantee approval.

24. Listing Not As Described

Guests must promptly report material problems and provide evidence where safe, allowing the Host a reasonable correction opportunity. Refunds or adjustments may be considered where access cannot be provided, the Listing materially differs, essential included equipment is unavailable, a serious undisclosed safety problem exists or no reasonable solution is offered. Minor or accurately disclosed differences do not qualify.

25. Access Hunter Discretion

Where permitted by law, Access Hunter may make reasonable decisions concerning refunds, credits, payouts and adjustments based on evidence. This does not make Access Hunter the insurer, guarantor or provider of the Listing.

26. Mandatory Rights

Nothing removes cancellation, refund or consumer rights that cannot be waived. Mandatory law prevails over conflicting policy terms.

27. App Acceptance

By creating an account, accessing or using the Access Hunter app or website, making or participating in a Booking, listing property or equipment, purchasing a membership, or selecting an electronic acceptance box, you confirm that you have read, understood and agreed to these Terms and Conditions, the User Waiver, the Landowner and Access Provider Terms where applicable, the Booking Policy, the Liability Acknowledgement and any additional rules or policies presented through Access Hunter.

28. Governing Law

This Booking Policy is governed by Alberta, Canada law. Disputes will be resolved in courts in Red Deer, Alberta, Canada, subject to mandatory legal rights.

IMPORTANT: THIS ACKNOWLEDGEMENT DESCRIBES SERIOUS RISKS, INCLUDING THE POSSIBILITY OF PERMANENT INJURY OR DEATH.

I acknowledge and agree to the following:

Part A — General Acknowledgements

1. I am voluntarily participating in outdoor activities arranged through Access Hunter.

2. Access Hunter is a marketplace and booking facilitator and, unless expressly stated, does not own, possess, operate, inspect, supervise or control listed land, ice shacks, equipment or activities.

3. Hosts, Landowners and Access Providers are independent from Access Hunter.

4. I am responsible for deciding whether activities, locations, conditions and equipment are suitable for me and my group.

5. I will comply with laws, regulations, licences, permits, Host instructions and Booking rules.

6. Emergency assistance may be delayed or unavailable due to distance, weather, terrain, roads, ice or communications.

Part B — Hunting Land Access

7. A Booking provides limited permission to access the identified area during the authorized period.

8. It does not authorize neighbouring land, restricted areas or property outside confirmed boundaries.

9. Maps, pins, signs, fences and verbal directions may not perfectly identify legal boundaries.

10. Where a boundary is unclear, I will stop and obtain clarification.

11. I am responsible for all required hunting and firearm licences, certificates, tags and permits.

12. I am responsible for lawful dates and times, open seasons, lawful species and quotas, equipment and methods, tagging and reporting, firearm restrictions, vehicle rules and retrieval requirements.

13. Permission to enter land does not guarantee that hunting or firearm discharge is lawful everywhere.

14. Wildlife is unpredictable and Listings do not guarantee presence, visibility or availability.

15. No refund will be sought solely because wildlife was not observed or harvested.

16. Rural land may contain uneven terrain, hidden holes, wells, pits, cliffs, water crossings, unstable trees, fences, livestock, machinery, pesticides, fuel, other hunters, wildlife, insects, disease, fire, smoke, extreme weather and limited communications.

17. I will treat every firearm as loaded, control the muzzle, identify the target and beyond, and keep my finger away from the trigger until ready to fire.

18. I will not discharge toward people, residences, vehicles, roads, livestock or equipment; without a safe background; outside approved areas; while impaired; where prohibited; or without clear target identification.

19. I am responsible for safe storage and transport of firearms, ammunition and hunting equipment.

20. I will not be impaired by alcohol, cannabis, medication or other substances while handling firearms, operating vehicles or participating in hazardous activities.

21. I will respect crops, livestock, gates, fences, habitat, roads, structures and neighbouring property.

22. I will remove waste and comply with carcass-handling and disposal instructions.

23. I will immediately report firearm incidents, injuries, lost persons, property damage, suspected wildlife offences or emergencies to 911 or the appropriate authority.

Part C — Ice Shack Rentals

24. Activity on frozen water is inherently hazardous.

25. No frozen surface is completely safe.

26. Ice strength and thickness can vary over short distances and change rapidly.

27. Conditions may be affected by temperature, wind, snow, currents, springs, flowing water, cracks, ridges, aerators, structures, traffic, fishing holes, shorelines and seasonal deterioration.

28. A Host measurement, statement, photograph, route or prior use does not guarantee safety at another time or place.

29. I am responsible for deciding whether to walk, drive, park or remain on frozen water.

30. I will obey closures, warnings, marked routes, vehicle restrictions and Host instructions.

31. Falling through ice may cause cold-water shock, hypothermia, drowning, injury or death.

32. I am responsible for suitable emergency and cold-weather equipment.

33. Ice shacks may involve fuel-burning heaters, carbon monoxide, inadequate ventilation, open flames, hot surfaces, generators, electrical systems, fuel, slippery surfaces, fishing holes, sharp equipment, overcrowding, extreme cold and delayed emergency response.

34. I will follow heating, ventilation and carbon monoxide instructions.

35. I will not block vents, disable detectors or modify heating, electrical or fuel systems.

36. I will not introduce unauthorized heaters, generators, cooking appliances, fuel containers or hazardous equipment.

37. I will supervise children and persons requiring assistance near holes, heaters and exits.

38. I will comply with occupancy limits.

39. I will not smoke or use open flames unless expressly permitted.

40. I will immediately leave and seek fresh air if a carbon monoxide alarm activates or symptoms arise.

41. Power, heat, cellular service and utilities may fail, and I will maintain backup clothing and supplies.

42. I will comply with fishing licences, limits, seasons, equipment rules and shelter requirements.

Part D — Vehicles And Equipment

43. I am responsible for deciding whether my vehicle, trailer, snowmobile or all-terrain vehicle is suitable.

44. Snow, mud, ice, water, narrow roads, steep terrain and poor visibility may cause collisions, rollovers or stranding.

45. I am responsible for insurance, towing, recovery and vehicle damage except where another person is legally responsible.

46. I will not operate vehicles or equipment while impaired, unlicensed or contrary to instructions.

47. I will inspect rented equipment and report visible defects.

48. I will not use equipment for unauthorized purposes or beyond rated capacity.

Part E — Group Responsibility

49. Where I make a group Booking, I will ensure every participant is included where required, receives rules and safety information, completes required waivers, holds required licences and is appropriately supervised.

50. I accept responsibility for minors and persons under my care.

51. I will not allow an unqualified, unlicensed, impaired or unauthorized person to handle firearms, operate equipment or participate in regulated activities.

Part F — Assumption Of Risk

52. Safety practices reduce but do not eliminate risk.

53. I knowingly and voluntarily accept risks of land access, hunting, fishing, frozen-water travel, ice shack occupancy, rural transportation and related activities.

54. I accept the possibility of property loss, serious injury, permanent disability, illness and death.

55. This acknowledgement supplements and does not replace the User Waiver, Terms and Conditions, Booking Policy and Listing rules.

Part G — Confirmation

By accepting this document, I confirm that I have read and understood it, had an opportunity to ask questions, understand that Access Hunter and Hosts cannot guarantee safety, understand my legal and safety responsibilities, accept it voluntarily, and confirm the information I provided is accurate.

Part H — App Acceptance

By creating an account, accessing or using the Access Hunter app or website, making or participating in a Booking, listing property or equipment, purchasing a membership, or selecting an electronic acceptance box, you confirm that you have read, understood and agreed to these Terms and Conditions, the User Waiver, the Landowner and Access Provider Terms where applicable, the Booking Policy, the Liability Acknowledgement and any additional rules or policies presented through Access Hunter.

Your continued use of Access Hunter constitutes your electronic acceptance of these documents and your agreement to be legally bound by them to the fullest extent permitted by law.
